Umuejechi Nekede community in Owerri West Local Government Area of Imo State, has called on Governor Hope Uzodinma to obey the judgements of both the High Court and Court of Appeal which according to the community, delivered judgements over the ownership of the Nekede Zoo land in their favour.
In a letter dated “20/12/2023,” addressed to the Imo State governor, and signed by their legal counsel, U. B. O Obinna of U. B. Okoro Obinna & Co, Rumuigbo, Port Harcourt, Umuejechi Nekede Community lamented the alleged “Continuous Trespass into the lands comprised in the defunct Agriculture Development Corporation (ADC) Nekede and contempt of orders of court of competent jurisdiction” by the Imo State Government.
The letter reads in part: ” We have observed with dismay, the wanton and reckless acts of trespass into the land comprised in the former Agriculture Development Corporation by your agents, apparently on your orders, and the intimidation of our clients by security operatives…
“Please, be reminded that the land is the bona-fide property of our clients by the judgement of a court of competent jurisdiction in Suit No. HOW/603/2018 Dr Etofolam Osuji & ORS v. Governor of Imo State & ORS, which declared our clients the owners of the land and restrained you and your agents from further trespass into the land.
“Your appeal to the Court of Appeal in Suit No. CA/OW/222M/2020: Gov of Imo State & ORS v. Dr Etofolam Osuji & ORS, was unsuccessful and you have further appealed to the Supreme Court before whom the matter is pending.”
Umuejechi Nekede community stated that a motion for an order of injunction pending appeal, restraining the Imo State Government from “dissipating the land and sharing it, was before the Supreme Court.
The community said the alleged actions and activities of the Imo State Government and its agents on the land, including clearing and parcellating it, were allegedly “contemptuous of the orders of courts of competent jurisdiction, an affront on the rule of law, as well as illegal.
The community implored Governor Uzodinma to abide by the orders of court and stop all activities on the land while both parties awaited the decision of the Supreme Court on the matter.
